APPLYING FOR A DESIGN REGISTRATION

1) Two application forms should be filed for each application.

2) Three identical pictures from each direction of view (perspective view, bottom view, etc.) must be included with the application. The applicant should decide on the number of perspectives to be submitted in accordance with the nature of the object/ photographs or drawings should be attached to white folio size paper and the applicant should indicate by each picture the relevant direction of view. Engineering drawings are not suitable. Measurements are not relevant to the registration of a design.

3) A receipt indicating payment of filing fees in the Postal Bank account of the Patent Office should be filled along with the application.

4) Deposit slips are available from the Patent Office.

5) One of the application forms will be returned to the applicant with the filing date of the application and the application number. The applicant may note on the product the number allocated to the application on condition that there is a clear indication that it is merely an application for registration.

SETS:

Only one item may be registered with each application. However, in the case of a "set" it is permissible to submit more than one item in one application. A set is a group of items of a similar nature which are customarily soda together or are intended to be used together. Examples of sets include cutlery, chess pieces, cups & saucers, etc.

 

 

 

EXAMINATION AND CERTIFICATE OF REGISTRATION:

The Patent Office conducts a search of registered designs. If an identical or very similar design is not found the application is allowed and a certificate of registration is granted. The owner of a registered design has exclusive rights. In the case of infringement of these rights the owner is entitled to institute proceedings against the infringer. A certificate of registration is evidence of the design owner's rights in the design. A certificate of registration provides protection for a period of 5 (five) years from the date of application. It is possible to extend this protection for two additional periods of 5 (five) years each upon the payment of the prescribed fee, at the prescribed time, by the design owner.

 

 

 

PUBLICATION:

After the certificate is presented, the Office publishes in the monthly Patents and Designs Journal the name of the design, the class of the design according to the international classification system, the filing date of the design and the design's filing number. The Office may not publish any picture of likeness of the design for a period of two years following the application date. In special circumstances and upon written application, the Commissioner may permit inspection of a registered design prior to the expiration two Years from the filing date.

 

 

 

APPLICATIONS FOR REVOCATION OF A DESIGN:

Any personae apply to the Commissioner for the revocation of a registered design on the grounds that the design was published in Israel prior to the application date. The Court may hear revocation on other grounds.

 

 

 

PRIORITY DOCUMENT:

If the applicant also wishes to register the design overseas, he should lodge applications with the Patent Offices of the various countries in which he would like to obtain design protection. The applicant may obtain a certificate known as a "Priority Document" from the Israel Patent Office upon submission of the prescribed application including a photograph or drawing identical to those already lodged in the Israel design application and the payment of the prescribed fee. The certificate endorsee that the applicant fielded and identical application in Israel. Based on the certificate the applicant is entitled to file design application overseas within six months of his original application and to receive the application date received in the original application.

 

 

 

APPLICATIONS FROM ABROAD:

Please note that an address for service in Israel must be provides.

The Patent Office will not send letters or notices regarding design applications of registrations to foreign addresses.

 

 

 

REPRESENTATION:

An applicant for a design may prosecute his application alone of may be represented by a patent agent of lawyer registered to practice in Israel.

Registration of Trade or Service Marks in Israel

1) Israel is a member of the Paris Convention for the Protection of Industrial Property, the Madrid Arrangement for the Prevention of False Indications of Origin, of the Arrangement of Nice for the International Classification of Goods and Services, the Arrangement of Lisbon for the Protection of Appellations of Origin, all as revised at Stockholm in 1967 and of the Madrid Protocol to the International Registration of Trademarks.

 

2) Any person claiming to be the proprietor of a Trade or Service Mark used or proposed to be used by him in Israel, may apply for the registration of the mark in Israel.

 

3) Application may be made by the owner of the mark or by an agent acting in the name of, and on behalf, of the owner. The agent must be a patent attorney or lawyer having a place of business in Israel and must be duly authorized in writing by the owner of the mark to act on the owner’s behalf.

Since applicants residing outside of Israel have to furnish an address for service in Israel, it is advisable for them to file their application through a local patent attorney or lawyer.

 

4) An application for registration of a Trade or Service Mark must be made on the prescribed form in which a representation of the mark must be appended.

A trade or service mark must be registered in respect of particular goods or services. Every application for the registration of a mark must specify goods or services. Each application for the registration of a mark must specify goods or services falling all of which must appear within a singular class as such classes are defined by the Arrangement of Nice for the International Classification of Goods and Services.

A separate application is required to be filed for goods or services in each class in which a mark is to be registered.

 

5) The application is examined as to distinctiveness of the proposed trade or service mark and as to whether it is precluded from registration by one of the specific provisions stated in the Ordinance (prior registration of same or similar marks, etc.).

 

6) If the mark is considered to be acceptable for registration, details of the application are published in the Trademarks Journal. Any person who desires to oppose the registration may give written notice of his intention to do so, during a period of three months from the date of publication. The notice must state the grounds for the opposition and the opponent’s address for service in Israel, Subsequent procedures regarding the filing of applicant’s counterstatement, opponent's and applicant’s evidence and opponent’s evidence in reply, are regulated by Sections 37 to 40 of the Trade Marks Rules. On completion of the evidence, the Commissioner will invite the parties to a hearing on their claims.

 

7) If there is no opposition, the mark is registered for an initial period of ten (10) years and a Certificate of Registration is issued to the registered proprietor. After ten years the mark may be renewed for periods of fourteen (14) years each.

 

8) Before filing an application for registration of a trade or service mark, a search can be initiated in the Registrar database.

 

9) There is no obligation to prove registration of the trade or service mark in the country of origin, unless the benefit of the provision corresponding to Article 6 quinquies of the Paris is requested.

 

10) Under the terms of the Paris Convention, a person who has made an application to register a trade or service mark in a country which is a party to the Convention has a right to claim priority of date for the application in Israel in respect of the same mark to be registered for the same goods. An application claiming such priority must be made within six (6) months from the date of the first application in a Convention country.

The Trade Marks Ordinance as now in force also provides for the registration of collective marks and certification marks.

In special cases there is a possibility for fast examination. The applicant has to prove the need for fast procedure, and to pay the fixed fee.
